Hey Meghan – here is how our policy expert explained to me: If the judge dismisses the case as soon as it is filed, the plaintiff pays defendant's attorney fees. Similarly, if the defendant files a motion for early dismissal and doesn't get it, he or she pays the plaintiff's attorney fees for defending against the motion.

This is the “loser pays” component of the bill and the governor is pleased with the result of this legislation – it truly will strengthen our legal system, cut down on frivolous lawsuits, and protect jobs by keeping Texas job creators in the office and out of the courtroom.
